Occasionally a party wall matter moves beyond the ordinary award procedure and becomes contentious – a surveyor’s award is appealed to the county court, or damage and liability are disputed. In those cases our panel of experienced party wall surveyors can act as an expert witness under the Party Wall etc. Act 1996, providing independent technical evidence to the court.
When a party wall expert is needed
- Appeals against a party wall award under section 10(17) of the Act
- Disputes over damage alleged to have been caused by notifiable works
- Questions over whether works were notifiable in the first place
- Assessment of the reasonableness of surveyors’ fees and awards
Independent and Act-compliant
Your expert reviews the notices, awards, schedules of condition and site evidence, then forms an impartial opinion on the matters in dispute. As with all our expert work, the report is prepared to the standards of Part 35 of the Civil Procedure Rules and the RICS, with the surveyor’s duty owed to the court.
